ONLINE SALES AND LEGAL AGREEMENT Any purchase of equipment from this web site is fully conditioned by the following agreement. Yourself, or your parent/legal guardian (if you are a minor) must read this agreement before you place an order from this web site. There are certain risks associated with the use of the skateboarding equipment. The best safety equipment and the most experienced riders cannot eliminate all risks. Some of these activities can be dangerous and can possibility cause bodily harm. Some of the risks involved are, but not limited to: bruises, cuts, sprains, broken bones, concussion, paralysis, and even death. The use of illegal drugs, alcohol, and tobacco, or riding equipment while physically exhausted or impaired, or using equipment without proper maintenance, can increase the risk for injury. Other risks include geographical conditions, hazardous terrain, and special weather conditions. Following manufacture’s recommendations for the equipment purchased from Skate Legion can help minimize some of the risks associated with these outdoor activities. If you purchase from Skate Legion’s web site you are agreeing to the following: I, the purchaser or user of the merchandise, agree to release Skate Legion, its owners, agents and employees, from any and all liability for damage, injury, paralysis and death to myself, any other person, or property, resulting from the use or misuse of the merchandise sold by Skate Legion. I, the parent of a minor child, agree to release Skate Legion, its owners, agents and employees, from any and all liability for damage, injury, paralysis and death to my child, any other person, or property, resulting from the use or misuse of the merchandise sold by Skate Legion. I have read and understand the terms of this agreement. I understand that my purchase and use of the merchandise sold by Skate Legion binds me to the terms of this Agreement. I understand that this Agreement releases Skate Legion from any and all claims of liability brought by myself, my minor children, and any other third party who uses the merchandise purchased from Skate Legion. ONLINE SALES RETURN POLICY IN ORDER TO RECEIVE A REFUND, YOU MUST CONTACT SKATE LEGION FOR A RETURN AUTHORIZATION NUMBER. YOU ARE RESPONSIBLE FOR SHIPPING THE ITEM BACK TO US. THE RETURN AUTHORIZATION NUMBER MUST ACCOMPANY THE ITEM YOU WISH TO RETURN. TO OBTAIN A RETURN AUTHORIZATION NUMBER, PLEASE CONTACT SKATE LEGION BY PHONE OR EMAIL. NO REFUND WILL BE ISSUED IF A PRODUCT IS SENT BACK WITHOUT A RETURN AUTHORIZATION NUMBER. Please include the following information with your return: Return Authorization Number Reason for the return Your Name Your Address Your Contact Phone Numbers RA Form The item(s) must be in new condition in the original packaging and/or with tags attached. Please include a copy of the original packing slip. Any discrepancies could result in a delay or forfeiture of your refund. If the product is not returned to us with all of the original packaging, or if it is determined that the product is not in "as-new" condition, you may choose to forfeit your refund or have the item sent back to you at your expense. For your security we recommend that you send all returns to Skate Legion using a carrier that provides tracking numbers. SKATEBOARDS Once a skateboard has been used it cannot be returned or refunded Broken decks or decks with stress cracks will not be returned or exchanged. Both are part of normal wear-and-tear and are not considered defects Gripped decks cannot be returned Complete Skateboards that are used cannot be returned CLOTHING All items must be returned in new, unused condition with tags still attached Once clothing has been worn and/or washed it cannot be returned or exchanged Skate Legion has the right to refuse a refund or exchange if the item looks worn, torn or scratched, smells of smoke, dirty, or is covered in pet hair DEFECTIVE PRODUCTS You must contact Skate Legion within 7 days of receipt of a defective product. Skate Legion does not guarantee the exchange or credit for a defective item. If you believe your product is defective please contact Skate Legion for a return authorization number. We will assist you in sending the item back. UPS will pick the item up from you. Please include a copy of the packing slip and the return form (RA Form) explaining the defect, your name, address, contact phone numbers and your (RA) Return Authorization number. If the product is determined to be defective upon receipt by Skate Legion, a full refund will be issued. PACKAGE DAMAGED UPON RECEIPT Always check for damage before signing for packages. If there is physical damage to the package, make a note with the driver/shipping company (most often UPS). After inspecting the contents and finding damage from shipper, contact Skate Legion. INCORRECT PRODUCT SHIPPING If we shipped you the wrong product or the wrong size, please accept our apologies and send us an email at crew@skatelegion.com We will give you a RA number (Return Authorization) and will send UPS to pick up the package from you. Please include a copy of your invoice, the RA number and your contact information. After returning the item to Skate Legion, we will promptly ship you the correct item NON-DEFECTIVE PRODUCTS YOU MUST CONTACT US VIA EMAIL OR CALL BEFORE RETURNING AN ORDER. NO REFUND WILL BE ISSUED IF A PRODUCT IS SENT BACK WITHOUT A RETURN AUTHORIZATION NUMBER. IN ORDER TO RECEIVE A REFUND YOUR PURCHASE MUST BE RETURNED WITH SHIPPING PRE-PAID. THE PACKAGE MUST INCLUDE THE RETURN AUTHORIZATION NUMBER GIVEN TO YOU BY SKATE LEGION AND YOUR CONTACT INFORMATION. Non-defective products may be returned if the item is unopened and in a condition that allows for resale. You are responsible for sending the item(s) back to Skate Legion. Please include an RA form with your name, address and contact phone numbers, as well as a copy of the packing slip. A 10% restocking fee will apply. Skate Legion must receive returns within 30 days of the customer receipt date. Refunds will not be authorized after 30 days. REIMBURSEMENT OF PAYMENT Please allow a minimum of 72 hours for refunds to be processed. Additional time may be needed by individual banks. When Skate Legion receives a returned defective product, your credit card will be credited in full for the defective product plus the shipping charges. Customers returning non-defective products will receive a refund for the product returned, less the 10% restocking fee. We'll notify you via e-mail of your refund once we've received and processed the returned item. SHIPPING AND HANDLING Skate Legion does not accept C.O.D.'s on return items. Customers are responsible for return shipping charges. For your protection we suggest you return your merchandise via FedEx, UPS or insured Parcel Post. Skate Legion is not responsible for items lost in the mail. Everything shipped from Skate Legion is FOB.
